Transcript: Thank You! Correction Presentation Prison Inmate's Death Topic 1 June 18, 2020 inmate Christopher Howell (age 51) was beaten in his cell. On June 19th, 2020 Howell died from his injuries. But what HAPPENED!? What Occurred? Former prison guard Michael Riley murdered Howell. Riley threw Howell aggressively into his cell; then proceeded to beat the life out of him. Topic 2 Howell's Sentence Subtopic 1 Howell was serving a four year sentence. Howell was charged for stealing phone chargers from a Target and for grand theft auto. Christopher Howell Subtopic 2 Prison guard Howell (age 27) Known to be hot headed and have a bad temper. Had 22 excessive use of force incidents in a 12 month period leading up to Howell's death. Howell's Injuries Topic 3 Less than one minute in the cell Riley walked out. Howell was found laying down in his cell in a pool of blood. His injuries consisted of large cuts on his face and head; a fractured neck and multiple broken ribs. June 19, 2020 Howell was brought to the Orlando Regional Medical Center. Ethical egoism was used because Riley did not care what consequences happened he wanted Howell dead. Ethical Formalism was used because he had a motive and it was to kill Howell. They used their power and refused to give Tabor the medical attention that he needed until it was too late. Ethical Dilemma Ethics of Care They did not follow the ethics of care because their responsibilities is to protect and keep the inmate safe. The refusal of the of the medical attention shows that the employees did not care about the inmate. They did not uphold their responsibility and did not take care of their inmates. Ethical Theory Agree or Disagree Summary I do not agree with the officers and the other employees with their actions of the mal practice and medical neglect towards Tyler Tabor. Unfortunately Tyler Tabor is not the only case of medical negligence in the correctional system. There are so many cases of medical negligence in the systems and they need to be more well known. I believe if they are more known the would occur less. Payne also mentioned that prosecutors are not allowed to use the testimony of the victim for the death penalty. Therefore it meant the case could not be closed according to the 8th amendment (Oyez, 2020). Argument (Tennessee view point) They convicted Payne and sentenced him to death. According to the Tennessee courthouse, the Payne case which was aggravated and savage murder. One principle the Tennessee court uses is that punishment should fit the crime (Oyez, 2020). State's Argument Court decisions Court Decisions The decision was a 6-3 against Pervis Payne (Oyez, 2020). CHIEF JUSTICE William H. Rehnquist delivered the opinion (Oyez, 2020). JUSTICES Rehnquist, White, O’Connor, Scalia, Kennedy, and Souter voted against Payne, while JUSTICES Marshall, Blackmun, and Stevens dissented (Oyez, 2020). Reason Reason The Court's reason behind their ruling simply states that “virtually no limits are placed on the relevant mitigating evidence a capital defendant may introduce concerning his own circumstances” the prosecution must be allowed to submit similar counter evidence” (Justia, 2020).
